SOUTHERN BORDER, May 6, 2022 — Today, U.S. Customs and Border Protection (CBP) issued a memo announcing the elimination of Border Patrol Critical Incident Teams (BPCITs), which have repeatedly interfered with law enforcement investigations of agents involved in the killing and harming of community members. The Southern Border Communities Coalition (SBCC) commends CBP for taking this action and acknowledges the leadership of Commissioner Magnus, who was responsive to community concerns about BPCITs. It is no easy feat to change a longstanding and problematic practice within the agency, and the Commissioner has taken an important step.
The next step will be to fully account for the harm done by BPCITs over the three decades that they have operated and to assess where they have engaged in criminal acts of obstruction of justice. This includes the agents, supervisors and chiefs who have been involved in the BPCITs and their many permutations. To that end, we call on the Commissioner to ensure that all records of BPCIT activities are preserved so that they can be reviewed independently by external law enforcement investigators, congressional oversight committees, and prosecutors.
Earlier this week, family members of those who have died or have directly endured brutal and horrendous abuse by Border Patrol agents called for an end to the cover-ups and obstructions committed by BPCITs. Each of the powerful stories described the trauma and anguish felt by family members living without the justice and accountability that they deserve.
CBP, which includes the Border Patrol, is the largest federal law enforcement agency in the country. CBP’s lack of accountability and oversight paired with its culture of violence has resulted in the loss of lives of more than 200 U.S. citizens and noncitizens just since 2010. None of the agents involved have been held accountable. In fact, no agent in the near 100 year history of the agency has been convicted for countless homicides while on duty.
In October 2021, SBCC sent a letter to Congress to sound the alarm on the BPCIT cover-up units, which appear to be at the heart of impunity at the agency. After discovering the existence of these units, SBCC called for a congressional investigation. In January 2022, ten House and Senate committee and subcommittee chairs sent a letter to the Government Accountability Office (GAO) requesting an investigation into the involvement of these shadow units. Simultaneously, the chairs of two of these committees — the House Committee on Oversight and Reform and the House Committee on Homeland Security opened an investigation.
It is imperative that Congress and the GAO continue to pursue their investigations to get a full accounting for the actions of the BPCITs. Without it there can be no justice. Under no circumstances should anyone involved in these teams be transferred or reassigned to the Office of Professional Responsibility or given access to past, present, or future investigations of agents involved in killing and harming community members. That era has ended and prosecutors should now consider charges for obstruction of justice and other crimes where they are warranted.

“The elimination of cover-up teams — which engaged in obstruction of justice and acted only in the interest of agents, not the public — is an important first step towards addressing the longstanding problem of Border Patrol impunity. Not a single on-duty agent has been held accountable for taking the lives of hundreds since 2010. Independent investigators should now consider reopening these cases to ensure that families harmed find closure and justice.”
Maria Puga, wife of Anastasio Hernández Rojas, killed in 2010 said,
“It’s been hard for our family to be without Anastasio. He would have turned 54 years old this week. The Border Patrol lied about Anastasio’s death. They covered up what happened. Thanks to an eyewitness video we know the truth. We need our cases to be reviewed, and for these Border Patrol cover up units to be fully investigated.”
Valentín Tachiquín, father of Valeria Tachiquín killed in 2012 said,
“Valeria was a U.S. citizen who would have turned 42 years old this past month. That void will never be filled again. The police investigation in this case was not independent; border agents interfered every step of the way. Border agents detained and threatened a key witness to the killing. They were present at the autopsy and used it for their own reports. They allowed evidence to be run over, kicked and moved. We cannot trust investigations if there is no integrity and the Border Patrol is involved. If there have been cover-ups, agents involved must be brought to justice.”
Doña Taide, grandmother of Jose Antonio Elena Rodriguez, killed in 2012 said,
“My grandson, Jose Antonio, was 16 years old when he was killed. He would have been 26 years old this year. We leave a chair empty for him in the house to remember. He was walking next to the border fence near our home in Mexico, when he was shot and killed by a border agent who was standing on the U.S. side of the border wall. When Jose’s death was being investigated, the Border Patrol agents disappeared video evidence, and they picked up the biggest rocks lying nearby and claimed that Jose had thrown them at the border agent without any evidence to back their claim. There are so many anomalies in Jose Antonio’s case and it is because of the Border Patrol cover-up units. Jose Antonio’s case must be reexamined and reopened.”
Marisol García Alcántara, survivor of Border Patrol shooting in 2021 said,
“On June 16th 2021, I was a passenger inside a car driving through Arizona, when the Border Patrol pulled over the car. The car stopped and a border agent shot me in the head. I still have parts of the bullet in my brain and my life has changed forever. Although the Nogales police had the authority to investigate the use of force, it was the Border Patrol agents who got involved and interfered with the Nogales police investigation. I won’t stay silent. These cover-up teams must be brought to justice.”
Andrea Guerrero, executive director of Alliance San Diego said,
“We commend CBP for taking the monumental step of eliminating the Border Patrol cover-up units. This is an acknowledgement that these units have no place in investigations. The next and perhaps more important step is to recognize the harm done and take action to hold those responsible accountable. Without that, there can be no justice, and our communities and our nation remain vulnerable to Border Patrol agents, supervisors, and chiefs who have broken our trust, broken their oath, and broken the safeguards that protect us from government corruption and abuse. To move forward, we need an honest accounting of what has happened so that it never happens again.”

UU. emitió un memorando en el que anuncia la eliminación de los Equipos de Incidentes Críticos de la Patrulla Fronteriza (BPCIT, por sus siglas en inglés), que han interferido repetidamente con las investigaciones policiales de agentes involucrados en el asesinato y daño de miembros de la comunidad. La Coalición de Comunidades de la Frontera Sur (SBCC) encomia a CBP por tomar esta medida y reconoce el liderazgo del Comisionado Magnus, quien respondió a las preocupaciones de la comunidad sobre los BPCIT. No es tarea fácil cambiar una práctica problemática y de larga data dentro de la agencia, y el Comisionado ha dado un paso importante.
El próximo paso será rendir cuentas por completo del daño causado por los BPCIT durante las tres décadas que han operado y evaluar dónde se han involucrado en actos delictivos de obstrucción de la justicia. Cada una de las poderosas historias describió el trauma y la angustia que sienten los miembros de la familia que viven sin la justicia y la rendición de cuentas que merecen.
CBP, que incluye a la Patrulla Fronteriza, es la agencia federal de aplicación de la ley más grande del país. La falta de rendición de cuentas y supervisión de CBP, junto con su cultura de violencia, ha resultado en la pérdida de la vida de más de 200 ciudadanos estadounidenses y no ciudadanos solo desde 2010. Ninguno de los agentes involucrados ha sido responsabilizado. De hecho, ningún agente en los casi 100 años de historia de la agencia ha sido condenado por innumerables homicidios mientras estaba de servicio.
En octubre de 2021, SBCC envió una carta al Congreso para hacer sonar la alarma sobre las unidades de encubrimiento de BPCIT, que parecen estar al fondo de la impunidad en la agencia. Después de descubrir la existencia de estas unidades, SBCC pidió una investigación del Congreso. En enero de 2022, diez presidentes de comités y subcomités de la Cámara y el Senado enviaron una carta a la Oficina de Responsabilidad Gubernamental (GAO) solicitando una investigación sobre la participación de estas unidades en la sombra. Es imperativo que el Congreso y la GAO continúen con sus investigaciones para obtener una rendición de cuentas completa de las acciones de los BPCIT. Sin ella no puede haber justicia. Bajo ninguna circunstancia, ninguna persona involucrada en estos equipos debe ser transferida o reasignada a la Oficina de Responsabilidad Profesional ni debe tener acceso a investigaciones pasadas, presentes o futuras de agentes involucrados en matar y dañar a miembros de la comunidad. Esa era ha terminado y los fiscales ahora deben considerar los cargos por obstrucción de la justicia y otros delitos cuando estén justificados.

Valentín Tachiquín, padre de Valeria Tachiquín asesinado en 2012 dijo,
“Valeria era una ciudadana estadounidense que hubiera cumplido 42 años el mes pasado. Ese vacío nunca se volverá a llenar. La investigación policial en este caso no fue independiente; los agentes fronterizos interfirieron en cada paso del camino. Los agentes fronterizos detuvieron y amenazaron a un testigo clave del asesinato. Estuvieron presentes en la autopsia y la utilizaron para sus propios informes. Permitieron que las pruebas fueran atropelladas, pateadas y movidas. No podemos confiar en las investigaciones si no hay integridad y la Patrulla Fronteriza está involucrada. Si ha habido encubrimientos, los agentes involucrados deben ser llevados ante la justicia.”
Doña Taide, abuela de Jose Antonio Elena Rodriguez, asesinado en 2012 dijo,
“Mi nieto, José Antonio, tenía 16 años cuando lo mataron. Este año hubiera cumplido 26 años. Le dejamos una silla vacía en la casa para recordar. Estaba caminando junto a la valla fronteriza cerca de nuestra casa en México, cuando un agente fronterizo que estaba parado en el lado estadounidense del muro fronterizo le disparó y lo mató. Cuando se investigaba la muerte de José, los agentes de la Patrulla Fronteriza desaparecieron las pruebas de video, recogieron las rocas más grandes que se encontraban cerca y afirmaron que José se las había arrojado al agente fronterizo sin ninguna evidencia que respaldara su afirmación. Hay tantas anomalías en el caso de José Antonio y es por las unidades de encubrimiento de la Patrulla Fronteriza. El caso de José Antonio debe ser reexaminado y reabierto.”
Marisol García Alcántara, sobreviviente del tiroteo de la Patrulla Fronteriza en 2021 dijo,
“El 16 de junio de 2021, yo era un pasajero dentro de un automóvil que conducía por Arizona, cuando la Patrulla Fronteriza detuvo el automóvil. El coche se detuvo y un agente fronterizo me disparó en la cabeza. Todavía tengo partes de la bala en mi cerebro y mi vida ha cambiado para siempre. Aunque la policía de Nogales tenía la autoridad para investigar el uso de la fuerza, fueron los agentes de la Patrulla Fronteriza quienes se involucraron e interfirieron con la investigación policial de Nogales. no me quedaré callado. Estos equipos de encubrimiento deben ser llevados ante la justicia.”
Andrea Guerrero, directora ejecutiva de la alianza san diego dijo,
“Aplaudimos a CBP por dar el paso monumental de eliminar las unidades de encubrimiento de la Patrulla Fronteriza. Este es un reconocimiento de que estas unidades no tienen cabida en las investigaciones. El siguiente paso, y quizás más importante, es reconocer el daño causado y tomar medidas para responsabilizar a los responsables. Sin eso, no puede haber justicia, y nuestras comunidades y nuestra nación siguen siendo vulnerables a los agentes, supervisores y jefes de la Patrulla Fronteriza que han roto nuestra confianza, roto su juramento y roto las garantías que nos protegen de la corrupción y el abuso del gobierno. Para avanzar, necesitamos un recuento honesto de lo que ha sucedido para que nunca vuelva a suceder.”
