Southern Border - In response to a recent Texas court order implicating Sierra Club and the Southern Border Communities Coalition’s (SBCC) settlement with the U.S. government concerning the illegal use of military construction funds for border wall projects, Sierra Club and SBCC took decisive action to protect the agreement’s vital remediation projects by filing a Motion to Intervene in the case.

Represented by the American Civil Liberties Union Foundation, ACLU of Texas, and ACLU of Northern California, the settlement reached in Sierra Club v. Biden (formerly Sierra Club v. Trump) followed President Biden’s January 2021 proclamation that his administration would no longer illegally divert military construction and Treasury forfeiture money to build wasteful and destructive border walls directly contrary to Congress’s enacted and limited appropriations for border wall construction.  Central to the settlement agreement were provisions outlining critical remediation measures aimed at mitigating the extensive harms to communities and wildlife caused by the illegal construction of over 400 miles of wall, and to protect endangered and threatened animal species harmed by this border wall construction.

Despite this binding legal agreement, the federal government has now stopped complying with the border wall settlement in response to developments in General Land Office of Texas v. Biden, a separate case. To protect the essential remediation projects included in the settlement, Sierra Club and SBCC moved to intervene.

“After years of hard-fought litigation against President Trump’s illegal fund transfers to build more border wall, preserving the remediation projects secured through settlement and holding the federal government accountable for promises made to border communities is essential,” said Ricky Garza, Border Policy Counsel for Southern Border Communities Coalition. “SBCC remains dedicated to ensuring that the government follows through on its commitments and acknowledges the importance of upholding the dignity and rights of all border residents.”

"Illegal border wall construction has proved not only to be a waste of money but also an ecological disaster that will continue to have long-term consequences,” said Erick Meza, Sierra Club Borderlands Coordinator. “The settlement agreement offers hope to restore some of the damage, but the recent injunction once again puts politics and economics above the environment and border communities' well-being. We will continue the fight to protect our agreement and hold the government accountable"

“Wildlife and borderland communities pay the price when politicians prioritize destructive, ineffective walls over solutions like comprehensive immigration reform. Animals, including the endangered Texas ocelot, perish in fire and flood when they become trapped by the border wall,” said Dave Cortez, Director of the Sierra Club Lone Star Chapter. “It is essential that remediation work continues and that border communities and their residents - both human and wildlife - are protected.”

SIERRA CLUB, SOUTHERN BORDER COMMUNITIES COALITION, Y ACLU ACTÚAN PARA PROTEGER EL ACUERDO DE REMEDIACIÓN DEL MURO FRONTERIZO ANTE LA DECISIÓN DEL TRIBUNAL DE TEXAS

Frontera Sur - En respuesta a una reciente orden de una corte en Texas que implica al Sierra Club y a la Southern Border Communities Coalition (SBCC) en un acuerdo con el gobierno de los EE. UU. sobre el uso ilegal de fondos de construcción militar para proyectos de muro fronterizo, el Sierra Club y SBCC tomaron una acción decisiva para proteger los proyectos vitales de remediación del acuerdo presentando una Moción de Intervención en el caso.

Representados por la American Civil Liberties Union Foundation, la ACLU of Texas y la ACLU of Northern California, el acuerdo alcanzado en Sierra Club v. Biden (anteriormente Sierra Club v. Trump) siguió a la proclamación del presidente Biden en enero de 2021 de que su administración ya no desviaría ilegalmente fondos de construcción militar y de confiscación del Tesoro para construir muros fronterizos y destructivos directamente contrario a las asignaciones promulgadas y limitadas del Congreso para la construcción de muros fronterizos. Central para el acuerdo de conciliación fueron disposiciones que delinearon medidas críticas de remediación destinadas a mitigar los extensos daños a las comunidades y la vida silvestre causados por la construcción ilegal de más de 400 millas de muro, y proteger a especies animales en peligro y amenazadas perjudicadas por esta construcción del muro fronterizo.

A pesar de este acuerdo legal vinculante, el gobierno federal ha dejado de cumplir con el acuerdo del muro fronterizo en respuesta a los desarrollos en el caso separado General Land Office of Texas v. Biden. Para proteger los proyectos de remediación esenciales incluidos en el acuerdo, Sierra Club y SBCC presentaron una moción de intervención. 

"Después de años de litigio arduamente disputado contra las transferencias de fondos ilegales del presidente Trump para construir más muro fronterizo, preservar los proyectos de remediación asegurados mediante el acuerdo y responsabilizar al gobierno federal por las promesas hechas a las comunidades fronterizas es esencial", dijo Ricky Garza, Asesor Legal de Política Fronteriza para la Southern Border Communities Coalition. Continuaremos la lucha para proteger nuestro acuerdo y responsabilizar al gobierno".

"La vida silvestre y las comunidades fronterizas pagan el precio cuando los políticos dan prioridad a muros destructivos e ineficaces sobre soluciones como la reforma migratoria integral. Los animales, incluido el ocelote texano en peligro de extinción, perecen en incendios e inundaciones cuando quedan atrapados por el muro fronterizo", dijo Dave Cortez, Director del Lone Star del Sierra Club Chapter. "Es esencial que el trabajo de remediación continúe y que las comunidades fronterizas y sus residentes, tanto humanos como animales, estén protegidos".
