SOUTHERN BORDER, July 12, 2022 — On July 8, 2022, CBP’s Office of Professional Responsibility released a disappointing 500+ page report on their sham investigation into the abuse of Haitian migrants in Del Rio, Texas in September of 2021. Nearly ten months later, and with no interviews from victims or other Haitian migrants who witnessed the incident, the investigation concluded there was no evidence that Border Patrol agents struck any person with their reins intentionally nor did agents prevent migrants from seeking safety, which is the opposite of what the photos and agent testimonies showed and what witnesses told the Southern Border Communities Coalition (SBCC).
Back in September 2021, the Southern Border Communities Coalition sent a delegation to Del Rio to get a better understanding of the situation on the ground. Members of the delegation were invited by the Department of Homeland Security (DHS) to tour the government’s operational response to Haitian migrants seeking protection near the Del Rio - Acuña International Bridge. After bearing witness to the vestiges of an encampment that had been cleared hours before, members of the delegation expressed deep concern and stood united in their call for the Biden administration to communicate the whereabouts and wellbeing of the Haitians moved out of their view. SBCC also called on the administration to stop the deportations and extend protections to Haitians consistent with our moral and legal obligations.
Lastly, SBCC called for an independent and impartial investigation of border agents who appear to have violated the civil and human rights of Haitian migrants as part of a long pattern of abuse and impunity at the border – particularly aimed at Black and Brown immigrants. The Biden administration failed to provide an impartial investigation of border agents, as the 500-page report did not include any direct interviews of Haitian migrants or witnesses to the abuse that took place.
Jean Elise Durandisse, pastor with the Haitian Ministry of San Diego said,
“There can be no real investigation of Del Rio that does not include the voices of those directly impacted–Haitian migrants. CBP agents on horseback were clearly attacking Haitian migrants seeking safety. Requesting protection at the border is LEGAL under U.S. law. We know what we saw — violent, racist abuse against Black migrants. As someone who was part of the SBCC delegation that traveled to Del Rio in September 2021 to bear witness to the treatment of Haitian migrants, it was clear that migrants were being moved by the thousands each day, away from the public eye, in order to cover the border patrol from public scrutiny. This sham investigation fails to hold CBP accountable for their abuses.”

“CBP did not interview a single Haitian person during their investigation, which in and of itself is evidence of a sham investigation. Furthermore, there were no clear operational objectives understood by the horse border patrol units, radio communications were “unsecured” and not recorded, and agents allegedly followed radio orders to close a boat ramp, but did not know who was issuing the order. At every level, CBP contributed to the chaos and suffering imposed on Haitians who were only trying to feed their families because no food was available at the encampment. This investigation never aimed to deliver justice; it only aimed to obfuscate the issues and to protect the racism, cruelty and incompetence of Border Patrol agents. These agents and their supervisors should be held accountable.”

Investigación falsa: El Reporte de CBP Sobre el Tratamiento de Migrantes en Del Rio
FRONTERA SUR, 12 de julio, 2022 — El 8 de julio de 2022, la Oficina de Responsabilidad Profesional de la Aduanas y Protección Fronteriza de EE.UU (CBP, por sus siglas en inglés) publicó un informe decepcionante de más de 500 páginas sobre su investigación falsa sobre el abuso de migrantes haitianos en Del Rio, Texas en septiembre del 2021. Casi diez meses después, y sin entrevistar a las víctimas u otros migrantes haitianos que presenciaron el incidente, la investigación concluyó que no hubo evidencia de que los agentes de la Patrulla Fronteriza golpearan a ninguna persona con las riendas intencionalmente ni los agentes impidieron que los migrantes buscarán seguridad, que es lo contrario de lo que mostraron las fotos y los testimonios de los agentes y lo que los testigos dijeron a la Coalición de Comunidades de la Frontera Sur (SBCC).
En septiembre del 2021, SBCC envió una delegación a Del Río para comprender mejor los acontecimientos ocurridos. Los miembros de la delegación fueron invitados por el Departamento de Seguridad Nacional (DHS) para recorrer la respuesta operativa del gobierno a los migrantes haitianos que buscaban protección cerca del Puente Internacional Del Río - Acuña. Después de ser testigos de los vestigios de un campamento que había sido despejado horas antes, los miembros de la delegación expresaron su profunda preocupación y se unieron en su demanda a la administración Biden para que comuniquen el paradero y el bienestar de los haitianos desplazados fuera de su vista. SBCC también demandó a la administración para detener las deportaciones y extender la protección a los haitianos de acuerdo con nuestras obligaciones morales y legales.
Por último, SBCC pidió una investigación independiente e imparcial de los agentes fronterizos que parecen haber violado los derechos civiles y humanos de los inmigrantes haitianos como parte de un largo patrón de abuso e impunidad en la frontera, particularmente dirigido a los inmigrantes negros y latinos. El gobierno de Biden no proporcionó una investigación imparcial de los agentes fronterizos, ya que el informe de 500 páginas no incluyó entrevistas directas a migrantes haitianos ni testigos del abuso que sucedió.

Esta investigación falsa no logra que CBP rinda cuentas por sus abusos”.

“CBP no entrevistó a ninguna persona haitiana durante su investigación, lo que en sí mismo es evidencia de una investigación falsa. Además, las unidades de la patrulla fronteriza a caballo no comprendieron claramente los objetivos operativos, las comunicaciones por radio eran “inseguras” y no se registraban, y los agentes supuestamente siguieron las órdenes por radio de cerrar una rampa para botes, pero no sabían quién estaba emitiendo la orden. En todos los niveles, CBP contribuyó al caos y el sufrimiento impuestos a los haitianos que solo intentaban alimentar a sus familias porque no había alimentos disponibles en el campamento. Esta investigación nunca priorizó el impartir justicia; solo tenía como objetivo ofuscar los problemas y proteger el racismo, la crueldad y la incompetencia de los agentes de la Patrulla Fronteriza. Estos agentes y sus supervisores deben responder por sus acciones”.
