Southern Border — In the midst of government actions that dehumanize migrants and violate international treaty obligations, the Southern Border Communities Coalition (SBCC) calls on all parts of the government to start with dignity in the treatment of migrants. Rather than humanize migrants, government officials are penalizing them for asserting their inalienable (human) rights to life, liberty, and the pursuit of happiness. It’s time for a reset on border policy. It’s time to refocus on human dignity. 

On the eve of Title 42 ending, the Biden Administration and Congress should be focused on policies that center human dignity and honor human rights, yet their actions do anything but that. Instead, the United States is violating a number of its international obligations, including the International Covenant on Civil and Political Rights (ICCPR), a treaty it ratified in 1992, rendering it the supreme law of the land under Article VI of the U.S. Constitution. Violations of specific ICCPR Articles include:

• Inciting hostility and violence toward migrants with the deployment of 1,500 troops signaling that migrants at the border represent a threat (Article 20).
  
• Denying due process to legitimate asylum seekers and expelling them through the expedited removal system without hearing their claims (Article 13).
  
• Denying in-custody migrants humane treatment in facilities and holding in-custody migrants in corralled areas outside (between barriers) without basic necessities (Article 10). 
  
• Subjecting migrants to cruel, inhuman, and degrading treatment through record levels of force, and policies that use death as a deterrence (Article 7). 
  
• Denying an effective remedy for above violations through the inaction of the legislative, administrative and judicial branches of government (Article 2). 

This October, the United States will be reviewed by its peers at the United Nations for its compliance (or lack thereof) with the ICCPR treaty — a treaty that the Biden Administration and Congress, as well as local and state governments, are bound to honor under the U.S. Constitution. The U.S. Government’s response to the ending of Title 42 is an opportunity to honor its commitment to uphold dignity.

• Someter a los migrantes a un trato cruel, inhumano y degradante a través de niveles récord de fuerza y políticas que utilizan la muerte como disuasión (Artículo 7).
  
• Negar un recurso efectivo por las violaciones anteriores a través de la inacción de los poderes legislativo, administrativo y judicial del gobierno (Artículo 2).

Este octubre, Estados Unidos será revisado por sus pares en las Naciones Unidas por su cumplimiento (o falta de cumplimiento) con el tratado ICCPR, un tratado que la Administración Biden y el Congreso, así como los gobiernos locales y estatales, están obligados a cumplir bajo la Constitución de los Estados Unidos. La respuesta del gobierno de los EE. UU. a la terminación del Título 42 es una oportunidad para honrar su compromiso de defender la dignidad.
